1. Terms of Service

1.1 Acceptance of Terms

By accessing or using the QRate.me platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

1.2 Definitions

  • “Company” refers to QRate.me.
  • “User” refers to any individual or entity that creates an account or otherwise uses the Service.
  • “Subscription” means the recurring plan selected by the User.

1.3 Service Description

QRate.me provides a web‑based tool that allows businesses to create digital menus or service lists accessible via QR codes.

1.4 User Obligations

  • Provide accurate account information.
  • Comply with applicable laws and regulations, including local health and data‑protection requirements.
  • Not upload unlawful, infringing, or harmful content.

1.5 Payments & Subscriptions

Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). Taxes may apply based on your location.

1.6 Refund Policy

  • Free‑Trial Period: If you cancel during the trial, no charges will be made, or any pre‑authorised amount will be voided/refunded.
  • Subscription after First Payment: You may cancel at any time. Future payments will stop immediately; however, your subscription remains active until the end of the already‑paid billing period.
  • One‑Time Services: Orders cancelled within 24 hours receive a full refund. After 24 hours, the service is considered consumed and non‑refundable unless required by law.

1.7 Intellectual Property

All trademarks, service marks, and content remain the property of the Company. Users retain ownership of content they upload but grant the Company a non‑exclusive licence to host and display it.

1.8 Limitation of Liability

The Service is provided “as is.” To the maximum extent permitted by law, QRate.me shall not be liable for indirect, incidental, or consequential damages.

1.9 Termination

The Company may suspend or terminate access if a User violates these Terms. Sections that by nature should survive termination (e.g., liability, intellectual‑property rights) will remain in effect.

1.10 Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in‑app banner at least 14 days before they take effect.

2. Privacy Policy

2.1 Data We Collect

  • Account Data: Name, email, billing address, payment details.
  • Usage Data: Log files, device information, IP addresses, and analytics on QR‑code scans.
  • Content Data: Menu titles, descriptions, images, and translations uploaded by Users.

2.2 Purpose & Legal Basis

We process personal data to provide and improve the Service (performance of a contract); send transactional emails (legitimate interest); and comply with legal obligations. Where required, we obtain consent (e.g., for marketing emails or non‑essential cookies).

2.3 Data Retention

We retain personal data for as long as your account is active plus up to 90 days for backups and audit logs, or longer if required by law.

2.4 Data Sharing

We share data only with service providers who support our operations (hosting, payment processing, analytics) under data‑processing agreements. We never sell personal data.

2.5 International Transfers

Where data is transferred outside the EEA/UK, we use Standard Contractual Clauses or another lawful mechanism.

2.6 Your Rights (GDPR & CCPA)

  • Access, rectify, or erase your personal data.
  • Object to or restrict processing.
  • Data portability.
  • Withdraw consent at any time (does not affect prior lawful processing).
  • Lodge a complaint with your Supervisory Authority.

3. Cookie Policy

3.1 What Are Cookies?

Cookies are small text files stored on your device. Some are necessary for the website to function (e.g., session cookies). Others help us analyse traffic or remember preferences.

3.2 Types of Cookies We Use

  • Essential: Authentication, fraud prevention.
  • Analytics: Aggregate usage statistics (e.g., Google Analytics).
  • Preference: Language choices.

You can control cookies via your browser settings. Non‑essential cookies are disabled until you grant consent via the cookie banner.

4. GDPR Compliance Statement

QRate.me acts as a Data Controller for User account data and as a Data Processor for content uploaded by Users. We have appointed a Data Protection Officer, maintain a Record of Processing Activities, perform regular DPIAs, and notify authorities of data breaches within 72 hours.
